By using the finox.ca website to obtain quotes for life insurance or other insurance of persons products, you acknowledge that you have read, understood and accepted the following terms. These terms constitute a contract between you, the user, and Services financiers Finox inc., the firm that manages the platform.

1. Referral process

The finox.ca website is managed by Services financiers Finox inc. Its main function is to put you in contact with authorized financial security advisors (our “Partners”) who can respond to your quote request.

Your request will be forwarded to one of our Partners, who may be advisors attached to major insurance companies (for example iA Financial Group, Canada Life) or independent brokers. If the quotes you obtain do not meet your expectations, you may submit a new request to be put in contact with other Partners.

2. Role of the advisor

Before proposing an insurance product to you, our Partner has the professional and legal duty to carry out a Financial Needs Analysis (FNA). The purpose of this analysis is to ensure that the insurance product matches your situation and your real needs. The FNA is a regulatory requirement in Quebec for the sale of insurance of persons products and is intended to protect consumers.

We strongly recommend that you always verify that the advisor is duly listed in the public registry of the Autorité des marchés financiers (AMF) before completing a transaction with them. Also be aware that all advisors must be members of the Chambre de la sécurité financière and complete continuing education to maintain their right to practise.

3. Limitation of liability

Services financiers Finox inc. acts exclusively as a referral service. We are not insurers. We are not responsible for the actions, recommendations, advice, rates or omissions of the Partners with whom you interact. Any insurance transaction is concluded directly between you and the advisor.

The platform is provided “as is”, without warranty of any kind. To the extent permitted by law, Services financiers Finox inc. shall not be held liable for indirect, incidental or consequential damages arising from the use of the platform. Our total liability to you, if any, is limited to the amount you have paid us for the use of the platform — which is nil, as our service is free.

4. No guarantee of rates or acceptance

The rates, premiums and examples displayed on the platform (including “starting at” figures) are provided for guidance only, are based on typical profiles, and constitute neither an offer, nor a contract, nor a guarantee of rate. The actual rate, eligibility and acceptance of a policy depend on the insurer’s assessment and your personal situation. We guarantee neither that you will obtain a quote, nor its rate, nor the approval of coverage.

5. Eligibility and accuracy of information

By using the platform, you declare that you are at least 18 years old, reside in Quebec and are using the service for personal and legitimate purposes. You are responsible for the accuracy and truthfulness of the information you provide; inaccurate or incomplete information may affect the quotes you obtain, without engaging our liability.

6. Intellectual property

All content on the platform (text, images, logos, layout) is the property of Services financiers Finox inc. or is used with permission, and is protected by applicable laws. Any unauthorized reproduction or use is prohibited.

7. Indemnification

You agree to indemnify and hold harmless Services financiers Finox inc. from any claim or damage arising from your use of the platform in violation of these terms or of applicable laws.

8. Changes to and interruption of the service

We reserve the right to modify, suspend or discontinue the platform, and to modify these terms, at any time and without notice. The applicable terms are those published on this page at the time of your use.

9. Severability

If any provision of these terms is found to be invalid or unenforceable, the other provisions remain in full force and effect.

10. Jurisdiction and complaints

These terms are governed by the laws of the Province of Quebec. In the event of a dispute or legal proceeding arising from the use of the platform or the interpretation of these terms, you agree that the appropriate venue for hearing such disputes is the judicial district of Québec (Quebec City), Province of Quebec, Canada.

Any complaint regarding the service or an advisor’s recommendations must be addressed directly to the Autorité des marchés financiers (AMF).

11. Privacy and acceptance

By using the platform, you agree that your personal information will be collected, used and disclosed in accordance with our Privacy Policy. You also confirm that you have read, understood and accepted all of the provisions, obligations and commitments described in these terms.
